Extremely brief history of FOIA:
The Freedom of Information Act (5 USC § 552) (FOIA), was championed by John Moss starting in 1955, but only came to be passed into law on a July 4th, 1966. The Bill was updated and amended several times, in 1974 in response to Watergate, in 1976 in the Sunshine Act and again in 1986 through the Anti-Drug Abuse Act. In 1996, the Electronic Freedom of Information Act Amendments were passed. After September 11, 2001, Bush issued Executive Order 13233, limiting access to former presidential records. FOIA was amended to limit access to governmental records from foreign governments through the Intelligence Authorization Act of 2002. In 2007, Bush signed the OPEN Government Act, defining journalists as members of the news media. It also established the Office of Government Information Services, which oversees government compliance with FOIA. In 2016, the FOIA Improvement Act passed, which required federal agencies to create a central online portal that could be used to file requests.
Well, that’s the short story of the creation and evolution of FOIA. But now the important stuff. By exercising your rights and holding your government accountable you are likely to be listed on some terrorist watch list with the FBI these days. Well, there’s only so much they can do and only so much I can take without taking action. If you are like me, you might be looking for every way to defend freedom. FOIA is a way.

Under this Act, every man in the nation has access to governmental records ranging from internal agencies memoranda, congressional correspondences, records of misconduct of government employees, public-private contracts entered into by government, and so much more. A very common FOIA request is for law enforcement camera footage. That’s right, you can demand the body cam footage from that traffic stop last week, when the cop placed his hand inside of your vehicle, or refused to identify himself, or drew his firearm needlessly. By demanding this footage, you can produce admissible evidence in a lawsuit for rights violations against law enforcement (clown pirates).
But it is so much bigger than just that. Voting fraud, mismanagement, private dealings, harassment, and unjust and unconstitutional ordinances and codes and mandates. All of these can be exposed in court by bringing governments internal documents and doings to light.
FOIA is extremely simple to do. Though it is not always easy to get the government to do what it is supposed to after filing.
To share the process with you, I am sharing a recent FOIA request here with you, so that you can see how Liberty Uncensored files. Something to remember is that the government official who receives the FOIA request has a given period of time (different in every state) to respond to your filing. If they do not respond within that time, you can file suit and be awarded damages/compensation. In New Mexico, they have to respond with an expected timeframe for completion within 3 days, and complete the request within 15 days, unless they specify a longer time required to fulfill the request. If they do not do this, every day of delayed return can reault in $100 reward, and recovery of attorney fees. But that’s just the beginning for suits. Perhaps another time to dive into that.
Here is the example request that Liberty Uncensored filed with the County of Taos.
As you can see, this is a complex request for information. It asks for a lot of information. On the basis of being too burdensome, the request may be denied. But that would not be good for the county. They would have to defend their position in court because there is a clause in the request that says exempted parts of the request are to be ignored if found as such. Meaning they get me all the information they can from what was requested.
As a media outlet, fees are not to be assessed, as I have asked for emailed documents. I sent in the request as a media outlet, not needing to add my own name or address or other personal identifying information. An independent journalist under a brand can do this as well. or you can simply use your name, but still demand classification as media, as an independent journalist, if you can prove that you are writing for a publication. If not, the fees can get steep at times.
Stay tuned in for my analysis of the information I receive from this FOIA, and the lawsuit if they don’t do their duty. If you have some corruption in your town or city or county, think of ways to expose the criminals and flush them out by filing FOIA requests that can give you admissible evidence. Then drop the hammer on ‘em.
